Matthew R. "Matt" Davies was one of three defendants indicted by a Stockton, California, grand jury in July 2012 for cultivating marijuana for sale to licensed patients in California, whose use is legal under the California Compassionate Care Act of 1996.
The investigation began following a September 22, 2011 traffic stop of Davies, where he informed California Highway Patrol officer that he was responding to a burglar alarm at his warehouse, where marijuana was stored.
A federal search warrant was obtained and executed on the warehouse in Stockton, CA October 18, 2011, as well as other locations related to the dispensary. Davies' medical marijuana dispensary had accountants, lawyers, managers, and a staff of 75. He paid state sales tax and had state and local business permits.
The case raises important questions of the conflict between state and federal laws, since the cultivation and production of marijuana is legal in 18 states, and legal for recreational use in two.
Davies and the other indictees face a maximum of 40 years in prison if convicted.
